Helping a Client Rebuild After Domestic Abuse

I recently represented a client facing a challenging financial situation following the breakdown of her marriage. Having suffered domestic abuse, our client needed strong legal support to navigate her next steps, particularly after discovering that her former husband had been found guilty of offenses that prevented him from having unsupervised contact with their child.

The Goal: Ensuring Financial Security for Mother and Child

Our priority was to secure the best financial outcome for our client, ensuring she and her child had a suitable home post-divorce. With Section 25 of the Matrimonial Causes Act in mind, Alexandra aimed to achieve a greater than 50% share of the Former Matrimonial Home’s equity—an essential step in allowing her client to rehouse and move forward.

How We Achieved a Positive Outcome

  1. Issuing Financial Remedy Proceedings – The husband was uncooperative during voluntary financial disclosure, requiring us to take the matter to court to ensure full transparency.
  2. Making a Strong Legal Argument – Given that the client was the sole primary carer (as the husband was unable to have unsupervised contact), Alexandra successfully argued for a departure from the usual 50/50 division of assets, as permitted under Section 25.
  3. Negotiating a Fair Agreement – Through strategic discussions, Alexandra secured an agreement allowing the client to remain in the home until its sale. Upon sale, she was awarded 85% of the proceeds—providing the financial security she and her child needed.

The Result: A Fresh Start

With a court-approved financial consent order in place, our client retained 85% of the home’s equity and was able to move forward with her child. The parties also achieved a clean break, giving our client the peace of mind to start anew.
