Applying for a Grant of Probate
If you have been appointed as an executor in a Will, it will be your responsibility to administer the estate of your deceased loved one. We know that this may feel like an overwhelming task, particularly when you’re already going through a tough time. Our team can sensitively help you through each stage, ensuring that you are supported, and have all of the information that you need.
First, we will help you to apply for a Grant of Probate, a document that will grant you the legal permission that you need to administer the deceased’s estate.

Applying for Letters of Administration
If a person unfortunately passes away without a Will, their estate will be divided according to the rules of intestacy, meaning that only certain family members can inherit, and that this person will not have an executor.
In this case, the next of Kin will act as the estate administrator, responsible for completing the probate process. If you have been tasked with this role, we can help you to apply for Letters of Administration, granting you the legal powers that you need to administer the estate.

Frequently asked questions about probate
If a person passes away without writing a Will, their estate will be divided according to the rules of intestacy. This essentially means that only certain people will be able to inherit from the estate.
Creating a Will is the only way to ensure that your wishes are upheld once you pass away. Without one, this is unlikely to be the case.
When a person passes away, the executor will need to apply for a Grant of Probate, this grants them legal permission to carry out the probate process, which includes estate administration.
During the probate/ estate administration process, the executor will need to identify all assets, value the estate, pay Inheritance Tax and any other debts owed, and then divide the estate between the beneficiaries.
If a person does not have a Will, the next of Kin will carry out the probate process.
A Letter of Administration is a legal document that grants an individual permission to administer the estate of a deceased person. A Grant of Probate serves the same purpose, however there is a distinct difference.
When the deceased person does not have a valid Will, an appointed next of Kin must obtain a Letter of Administration and subsequently distribute the estate according to intestacy rules.
A Grant of Probate is a document required by the deceased’s Will executor. The executor needs this document to administer the estate according to the instructions in the Will.
